Dicamba OTT Update 2/16/2024

On February 6, 2024, the U.S. District Court of Arizona ruled vacating the 2020 registrations for over-the-top (OTT) dicamba products, XtendiMax® with VaporGrip® Technology (EPA Reg. No. 264-1210), Engenia® Herbicide (EPA Reg. No. 7969-472), and Tavium® Plus VaporGrip® Technology (EPA Reg. No. 100-1623).  In response to the Court’s ruling on February 14, 2024, the EPA issued an Existing Stocks Order to provide guidance on the dicamba OTT products already in possession of growers and in the channels of trade. Under this order, end users of existing stocks may only use the formerly registered products consistent with the previously approved labeling for the products and must stop the use of these products by the relevant dates laid out in the Order.

1. Sale or Distribution by Persons other than the Registrants

Persons other than the registrants, including but not limited to co-ops and commercial distributors, who are already in possession of these products as of February 6, 2024, may sell or distribute these products until May 31st (soybeans) and June 30th (cotton) in Georgia.

2. Use of Existing Stocks

As of the date of this order, use of XtendiMax, Engenia, and Tavium is permitted until June 30th (soybeans) and July 30th (cotton) in Georgia.

These product labels require annual dicamba training. University of Georgia Extension and the Georgia Department of Agriculture work together to offer Using Pesticide Wisely Trainings that meet this label requirement. We look forward to continue working with other organizations and our farmers and applicators to assist with pesticide stewardship training.

Updates will be provided as additional information becomes available or conditions change. Please see below for the schedule for the upcoming UPW training dates and locations. If you intend on applying one of the products mentioned above, you must attend at least one of these trainings.

Using Pesticides Wisely - Georgia 2024.

1. As mandated by federal labels, one must hold a private or commercial pesticide applicator license to purchase and use the restricted use herbicides Engenia, XtendiMax, and Tavium. Use is limited to ONLY those persons holding a private or commercial applicator certification. It is no longer permissible for non- certified applicators to apply these products under the direct supervision of the certified applicator.
2. Prior to applying these products in 2024, ALL applicators must be trained according to the federal labels. In Georgia, applicators must complete the 2024 UPW classroom training with locations provided below. On-line trainings WILL NOT be available.
3. Those needing pesticide credit but not applying Engenia, XtendiMax, or Tavium are welcome to attend.
4. Bring your pesticide license; 2 hours of pesticide credit for private or commercial will be offered.
5. The meeting will last about 1.5 hours; NO beverages or meals will be provided.
6. Attendee’s names will be placed on a list posted to the Georgia Department of Agriculture’s auxin website at https://agr.georgia.gov/dicamba.
