Notice of Intent to Repeal Rules relating to the Treated Timber Products Act of 1973

To All Interested Parties:

Pursuant to Senate Bill 357, passed during the 2012 Legislative Session, notice is hereby given that the Georgia Department of Agriculture will be repealing Chapters 40-22-1, 40-22-2, 40-22-3, 40-22-4, 40-22-5, 40-22-6, 40-22-7, and 40-22-8, and all departmental rules relating to the Treated Timber Products Act of 1973, specifically rules 40-22-1-.01, 40-22-2-.01, 40-22-3-.01, 40-22-3-.02, 40-22-4-.01, 40-22-5-.01, 40-22-5-.02, 40-22-6-.01, 40-22-7-.01, 40-22-8-.01 and 40-22-8-.02.  Written comments will be accepted from September 25, 2012, to the close of business (4:30 p.m.) on October 25, 2012.

Synopsis, Main Features, and Differences:

Senate Bill 357, passed during the 2012 Legislative Session, repealed the Georgia Treated Timber Products Act of 1973, O.C.G.A. §§ 2-14-100 through 2-14-113.  Because the Treated Timber Products Act was repealed via the Georgia Legislature, all rules promulgated pursuant thereto must be rescinded.

Therefore, the Georgia Department of Agriculture is repealing the following: Chapter 40-22-1, Rule 40-22-1-.01, “Definitions”; Chapter 40-22-2, Rule 40-22-2-.01, “Licensing Requirements”; Chapter 40-22-3, Rule 40-22-3-.01, “Standards for Preservatives,” and Rule 40-22-3-.02, “Prohibited Preservatives”; Chapter 40-22-4, Rule 40-22-4-.01, “Standards for Treatment”; Chapter 40-22-5, Rule 40-22-5-.01, “Standards for Results,” and Rule 40-22-5-.02, “Certain Products Exempted”; Chapter 40-22-6, Rule 40-22-6-.01, “Identification of Treated Timber Products”; Chapter 40-22-7, Rule 40-22-7-.01, “Shipping Documents”; and Chapter 40-22-8, Rule 40-22-8-.01, “Inspection and Sampling,” and Rule 40-22-8-.02, “Analysis and Examination of Samples.”

Comment Period and Additional Information:

The Department will be accepting written comments from September 25, 2012, to the close of business (4:30 p.m.) on October 25, 2012.  Comments will be considered on October 26, 2012.  Please submit written comments to:
