Notice of Intent to Consider the Modification of Rules relating to licensing of poultry dealers, brokers or poultry market operators, per O.C.G.A. §4-04-80 et seq.
TO ALL INTERESTED PERSONS AND PARTIES:
Notice is hereby given that the Georgia Department of Agriculture is considering the adoption of a rule modification relating to licensing of poultry dealers, brokers or poultry market operators on September 28, 2009, between the hours of 8:00 a.m. and 12:00 noon, (no hearing is scheduled), in Room 112 of the Agriculture Building, 19 Martin Luther King, Jr. Drive, Atlanta, Georgia 30334.
SYNOPSIS:
The Georgia Department of Agriculture was given the authority to create rules and regulations regarding live poultry dealers, brokers, and market operators through O.C.G.A. §4-4-2. As part of this authority, the Department created rules and regulations regarding the licensing of poultry dealers, brokers or poultry market operators.
It is hereby proposed that the term for which a poultry license expires, found in departmental rule §40-13-10-.04(2), be clarified to state, “The term of said license shall be for one year from the date of issue.”
The purpose of this rule clarification is to allow all poultry dealer licenses to expire one year from the date of issue in order to help the Department issue and renew licenses, as applications will be handled continuously throughout the year instead of being handled once per year. It will also be advantageous to the poultry dealer in that it avoids having to apply for a license and renewal within one year.
